Couple Fined for Having Garden: Florida to Impose $500 a Day Fine for Growing Vegetables

By Jessica Rodriguez , Christian Post Contributor

A couple could be fined for having garden if it is not destroyed by Thursday, reports have revealed this week.

Jason and Jennifer Helvenston, from Florida, have been warned they could face a fine of up to $500 a day if they have not removed their vegetable garden by Thursday. It has been found that they are violating a Florida state law that says people are prohibited from using their front gardens to grow vegetables.

My opinion:

Legalism says the couple is breaking the law and should suffer the consequences.

Grace says this is a bondage law and ought to be removed.

So, that means my Victory Garden is out then.

Must be a neighborhood association thing, in my brothers neighborhood, if you leave a car parked on the grass in the front yard overnight you will be fined.

This is no longer a issue.

Mike.

Please explain.

But they have nothing that guarantees the city won't go through with the lawsuit.

They could still be fined.

So it's still an issue.

As of Jan. 7, 2013 1:00 pm.

From an Institute for Justice press release:

When news of the story initially broke in early November, the city appeared inclined to help the Helvenstons navigate the city’s outdated ordinances while still being able to keep their garden. A special “task force” was created to consider amending the law to allow for front yard gardens. But as deadline after deadline was postponed, it has become evident that such tactics have simply allowed the city to delay its enforcement. Despite assurances from the city that the Helvenstons would be able to keep their garden or that the code would be updated to allow for some sort of compromise, there has been no official statement from the city that either will occur

The issue is surely about people's freedom. Why should something so harmless be criminalised. It's a situation of the "state" overstepping its role. This case may have been solved but it is not an uncommon problem.
