Kennedy was on the record during the Arizona immigration case and made some very concerning remarks. Ginsburg, during recess to consider the then gay marriage case, officiated a gay marriage while in New York state. Her remarks when this was found out should have not only concerned watchers of the docket, but had her abstain being her prejudice to the case was made apparent. Fresh blood is long overdue.
