I haven't read a Stephen King book since I got saved...those books really do give me nightmares...You could try, but I think the essence of the court case is that the believers of the text (us Christians) have marginalised him and possibly even persecuted him for being gay. It's happened before. Dare I say the "W" word - Westboro. I know they don't represent the majority of Christianity, but they are not alone and some Christians are that bad when it comes to dealing with this issue. In contrast, fans of Stephen King novels aren't going to call you names for not reading his books. I don't think he really stands a chance of winning though.
