It matters that they ruled it unconstitutional based not on the Constitution, but on emotion and rabid, far Left extremism.   The fact that it was NOT unconstitutional when Obama did the same thing, mitigates against it being unconstitutional.  It is an unlawful ruling that will hopefully be over ruled by the SC.

That is true, and had they not fallen down the job, the judges would have ruled it constitutional the same way it was constitutional  when Obama was in.   This "unconstitutional"  because it is Trump's travel ban and not Obama's.   It has nothing to do with the Constitution, this time.

That is not the only fact of the situation.  There are other facts, such as the fact that the ban was based on Trump's words as a candidate.   And the fact that it was considered constitutional when Obama did the same thing in 2015.  It is also a fact that the lawyers looked for the most liberal  judges that would give them what they wanted.

I've become accustomed to watching Prez Trump take credit for the work of others, but I still shudder when his supporters do the same in spite of the facts.

During the contentious Senate confirmation hearings for Gorsuch it was painfully obvious that the DNC still felt that they were "robbed" a SCOTUS justice during Obama's last term in office. Therefore they were not going to let Prez Trump nominate any conservative justice unless the GOP resorted to the "nuclear option" that Democrat Harry Reid so foolishly put into play before he retired.

And without that 51 minimum member vote rule in effect, Prez Trump couldn't get Gorsuch on the bench, period. So give credit where credit is due.

In 2013, the star of "The Apprentice" had nothing to do with Senator Harry Reid's short sightedness.

Credit does not belong to Harry Reid.  I'm sorry, but that is a really shallow understanding of the facts.  This has less to do with the nuclear option as much as it does with obstructionism.   Had the Democrat party not been simply opposed to Trump because....  well just because,  the nuclear option would not have been necessary. 

The Democrats questioned him and frankly, he Gorsuch proved he infinitely more than the people questioning him.  They knew his qualifications were sterling and that the was more than qualified for the job.   Their job was to vote based on his fitness for the job, and not because of who nominated him.

Trump gets the credit because Gorsuch was his nominee and Trump nominated the best man for the job.  Everyone knew it.  The nuke option was only used as a last resort because of the obstructionism of the Dems.  

To credit Harry Reid is just absurd.

No, it is another instance of activist judges not ruling according to the Constitution.   And by the way...  Trump was right.   We need to ban Muslims from immigrating to the US.   We should shut down Muslim immigration after 9/11.

Harry Reid made the appointment possible, but the groundwork for the Gorsuch nomination was laid by Mitch McConnell and the GOP Senate when it denied any consideration for SCOTUS under Obama's lame duck term.

Yeah, that's some pretty creative spin and mental gymnastics.   He was Trump's nominee.  Trump gets the credit and that's just how it works.

Yes, but the Constitution just keeps getting in our way -- unless you are in favor of Bernie Sander's "religion test" being applied against Christians as well as Muslims..
