Rape Sentence Thrown Out Over Bible Quote

A convicted rapist has had his 51-year prison sentence thrown out because the judge quoted the Bible during his sentencing.

A federal judge ruled yesterday that religious beliefs can't influence a judge's decision.

He says Hamilton County Common Pleas Judge Melba Marsh violated James Arnett's right to due process during his sentencing in 1998.

Arnett was accused of repeatedly raping the 8-year-old daughter of his fiance.

Marsh told Arnett that she struggled with his case because of the seriousness of the offense and that she turned to the Bible for guidance.

She then cited Matthew, chapter 18, versus 5 through 6 -- "And whosoever shall receive one such little child in my name, receiveth me. But whosoever shall offend one of these little ones which believe in me, it would be better for him that millstone were hanged about his neck, and that he were drowned in the depth of the sea."

The Ohio Attorney General's Office says they plans to appeal yesterday's decision.
