Afghanistan Contractor Pleads Guilty to Killing Man Who Burned Co-Worker

By Martin Weil

Washington Post Staff Writer

Wednesday, February 4, 2009; Page A06

A civilian contractor pleaded guilty yesterday to voluntary manslaughter in the killing in Afghanistan of a man who set the contractor's co-worker on fire, prosecutors said.

Don M. Ayala had been charged in federal court in Alexandria with second-degree murder in the Nov. 4 incident. According to the U.S. attorney's office, it took place in the village of Chehel Gazi, where Ayala and co-worker Paula Loyd were on a walking patrol with an Army platoon.

According to the prosecutor's office, Abdul Salam, an Afghan, doused Loyd with gasoline and ignited it. He fled, but Ayala and several U.S. soldiers tackled and restrained him, prosecutors said.

Minutes later, after Ayala was told of Loyd's condition and while Salam was still restrained, Ayala shot him in the head, according to the prosecutors' statement. Salam was killed instantly, the prosecutors said.

Loyd, 36, who was burned over 60 percent of her body, was taken to Brooke Army Medical Center in San Antonio. She died of her wounds there Jan. 7, the prosecutors said.

Court documents said Ayala, who is from New Orleans, began work Sept. 1 for Rockville-based BAE Systems. According to the documents, Ayala, a U.S. Army veteran in his 40s, at one time had provided personal security for top Iraqi and Afghan leaders while employed by companies that were not identified.

Sentencing is set for May 8, and the maximum penalty is 15 years.

Maybe Don M. Ayala should have opened up a dialogue with this Terrorist? :whistling:

So, are you saying the what he did was legal? Justified? the right thing to do?

Was dousing a woman in gasoline and igniting her, which subsequently caused her agonizingly painful death, then running away, a justified and righteous action and the right thing to do? Is allowing women to have gasoline poured on them and ignited something we want our foreign policy to project as an okay action fom Islam?

Of course not, but the discussion here is not about what the terrorist did, it is about the reaction to it.

Yes, yes and yes. In Texas we call it 'summary justice.' He was spared the kind of death this woman endured, at least. Remember, 'an eye for an eye, a tooth for a tooth'? Well, there you have it.

As to your first comments about our society, I don't see women regularly doused with gasoline and set afire in the U.S. I also don't see them writhing in agony after 60 some percent of their body is scorched so I'm not sure where the Morally Relevant argument is coming from.

So, then if you did see this happen you would be ok with the person who did it being shot in the head by the police?

There is no Moral Relevance. Islam is evil and woman are regularly abused under it. I can't say what I would have done if I were Mr. Ayala. :whistling:

This is irrelevant, I cant even say that I would not have done the same thing, but that still does not make it right or legal. Should it really be our goal to "out evil" Islam so we can win the war?

I do believe that this is the problem in regarding this War as a civil action. You are dealing with mutants who don't regard human life as sacred.

Even though I don

Okay, if you were on Jury Duty this particular day and happened to be the foreman because of your Military experience. What kind of sentence would you recommend for Mr. Ayala after the Judge told you the maximum was 15 years and there was no minimum? :emot-hug:

I dont know what I would do.

There is no moral relevance between our actions in this War and those of the enemy. :whistling: That is why it is not a civil action and must not be treated as one.

This is so wrong; this debases everything each member of the US Military stands for.

From day one we are taught the Laws of Warfare, the Code of Conduct, and such. We cannot let the actions of the enemy dictate how we are going to react. If we throw out our rules like you are suggesting, we have become the very thing we are fighting against. We might as well trade uniforms with them and go live in a cave.

I disagree, It was exactly because men like General George Washington threw out Miltary convention that we have Liberty. We will not defeat evil by playing conventional games of equivalency with it. It is not evil to meet evil with equal force and set a standard that we will not tolerate women being burned alive. It is exactly those standards that make us different and above the fray.

If I were the Foreman I would urge extenuating circumstances and recommend that the Judge let Mr. Ayala off with time served. Afghani and Islamic public opinion be damned, the woman there will probably be cheering. :emot-hug:

P.S. They don't wear uniforms and are cowards which is why they live in caves and douse women with gasoline igniting them and causing them agonizingly painful deaths. It is exactly why they lob unguided missles and mortars into civilian areas and strap bombs on their children and blow up innocent men, women, and children.

There is no moral equivalence between this enemy and us or our Soldiers. :whistling:

Let me get this straight, you are saying this would be legal in Texas?

You are saying that we dont need to have things like trials and such?

And it seems Jesus had a different view about the eye for an eye thing.

In Texas, many times killings are legal, depending on circumstances; this one, because it was retribution and not a protective action, probably would not be.

Sure, we need to have trials. This is America. But....the killing didn't happen here and, if you've been over there or know someone who has, it's a whole different world. They have basically no national law, very little court system and what little they do have is corrupt. This man is not a soldier either so he was not bound by the Geneva Conventions. The closest I can figure that he could be charged under would be Afghani law (which is Shar'ia law) and killing in retribution is not considered serious. You usually have to pay compensation to the family of your victim.

You are probably right that Jesus would not approve. But, just speaking from a legal standpoint.....the guy will probably walk. Let's be real here; if someone doused my friend in gasoline and set her afire.....I might kill that person too and I'll admit it. Wouldn't you? :whistling:

I didnt say it was not about the war, I said it was not about the actions of this terrorist, it was about the other person's reaction.

You post a verse about The Desire Of God, am I to take it from this you think that God desires the killing of an unarmed, bound prisoner?

    • You are coming up higher in this season – above the assignments of character assassination and verbal arrows sent to manage you, contain you, and derail your purpose. Where you have had your dreams and sleep robbed, as well as your peace and clarity robbed – leaving you feeling foggy, confused, and heavy – God is, right now, bringing freedom back -- now you will clearly see the smoke and mirrors that were set to distract you and you will disengage.

Right now God is declaring a "no access zone" around you, and your enemies will no longer have any entry point into your life. Oil is being poured over you to restore the years that the locust ate and give you back your passion. This is where you will feel a fresh roar begin to erupt from your inner being, and a call to leave the trenches behind and begin your odyssey in your Christ calling moving you to bear fruit that remains as you minister to and disciple others into their Christ identity.

This is where you leave the trenches and scale the mountain to fight from a different place, from victory, from peace, and from rest. Now watch as God leads you up higher above all the noise, above all the chaos, and shows you where you have been seated all along with Him in heavenly places where you are UNTOUCHABLE. This is where you leave the soul fight, and the mind battle, and learn to fight differently.

You will know how to live like an eagle and lead others to the same place of safety and protection that God led you to, which broke you out of the silent prison you were in. Put your war boots on and get ready to fight back! Refuse to lay down -- get out of bed and rebuke what is coming at you. Remember where you are seated and live from that place.

Acts 1:8 - “But you will receive power when the Holy Spirit has come upon you, and you will be my witnesses … to the end of the earth.”

    • Understanding the Enemy!

I thought I write about the flip side of a topic, and how to recognize the attempts of the enemy to destroy lives and how you can walk in His victory!

For the Apostle Paul taught us not to be ignorant of enemy's tactics and strategies.

2 Corinthians 2:112  Lest Satan should get an advantage of us: for we are not ignorant of his devices.

So often, we can learn lessons by learning and playing "devil's" advocate.  When we read this passage,

Mar 3:26  And if Satan rise up against himself, and be divided, he cannot stand, but hath an end.
Mar 3:27  No man can enter into a strong man's house, and spoil his goods, except he will first bind the strongman; and then he will spoil his house.

Here we learn a lesson that in order to plunder one's house you must first BIND up the strongman.  While we realize in this particular passage this is referring to God binding up the strongman (Satan) and this is how Satan's house is plundered.  But if you carefully analyze the enemy -- you realize that he uses the same tactics on us!  Your house cannot be plundered -- unless you are first bound.   And then Satan can plunder your house!

    • Abraham and Issac: Pictures of the Resurrection, Part 2
      Shalom everyone,

As we continue this series the next obvious sign of the resurrection in the Old Testament is the sign of Isaac and Abraham.

Gen 22:1  After these things God tested Abraham and said to him, "Abraham!" And he said, "Here I am."
Gen 22:2  He said, "Take your son, your only son Isaac, whom you love, and go to the land of Moriah, and offer him there as a burnt offering on one of the mountains of which I shall tell you."

So God "tests" Abraham and as a perfect picture of the coming sacrifice of God's only begotten Son (Yeshua - Jesus) God instructs Issac to go and sacrifice his son, Issac.  Where does he say to offer him?  On Moriah -- the exact location of the Temple Mount.
