SCOTUS decision Holder v. Humanitarian Law Project.  Incitement to an act of terrorism is against the law under the U.S. Patriot Act. It isn't covered under free speech. 

America has been threatened by the Islamic State. ISIS. Domestic terror acts by their operatives on domestic soil are evidence they and their operatives are here. A woman in Oklahoma was decapitated by a Muslim terrorist while at work. He attempted to decapitate a female coworker after and was shot by the off duty officer who was also the company CEO. He lived. 

Domestic terrorists serving the Islamic State are a clear and present danger in America. 

Incitement under Holder v. Humanitarian Law Project, is illegal. 
Holding up the head of our President, bloody and ripped , is considered incitement. Displaying the results of a murderous assault on Donald Trump, decapitated is an act, a display, in a manner demonstrated by ISIS terrorists in the homeland and abroad. And that is illegal. That is incitement. 
 

Burning a picture isn't the same thing. Holding up a representation of Donald Trump dead , bloody, decapitated, is sending the message that is how he should be. It is incitement to kill.

All of the above are in violation of the Constitution and deny our rights.  The patriot act is one of the worst things to have ever been forced on the American people, enabling the government to operate with impunity in violation of individual rights.  Do you honestly think Kathy Griffin is a greater threat to America than homeland security officers walking around in public with automatic rifles?
